DEBTOR / CREDITOR & BANKRUPTCY Virtually all businesses have been faced with the need to understand and respond to the challenges of reorganization and bankruptcy issues. On the creditor side, the firm counsels creditors regarding workouts, bankruptcy court appointed examiners, prepackaged and prearranged bankruptcies, defense of preference and fraudulent conveyance actions brought by trustees and debtors in possession, and filing and pursuing claims in bankruptcy proceedings. On the debtor side, the firm advises individuals and business entities in the preparation and filing of bankruptcy petitions and the administration of bankrupt estates, as well as more informal proceedings involved in the wind-up and liquidation of business and personal assets, including advice concerning workouts and similar arrangements with lending institutions.
